    In NZ the VAT (we call it GST) is payable on everything except financial transactions at 12.5%

    Its not the VAT issue, its the argument over what constitutes a teacake or biscuit. The fact that there has to be an EU regulation.

    In reality it must have cost much more than 3.5mil, you have to get a group of Euro-nobs together with some desserts so they can decide what is what. Probably over the course of a week or more. Then the usual wranglings and arguments. And they still got it wrong.

    I think you have mis-understood the article? The EU ruling was not whether a teacake is a cake or a biscuit, that was decided by the UK tax authorities back in 1994.

    The EU ruling was about whether a department store should be treated differently to a supermarket - after the ruling in 1994 the 20 years VAT that supermarkets had wrongly paid was refunded to them but the Goverment refused to refund the VAT to Marks & Spencer because they were not a supermarket.
