    Perhaps attempted manslaughter or more likely reckless endangerment.
    I you recall judges in the states had some problems ruling on such cases a few years ago.

    The only case I can recall off the top of my head yes the prosecutors were kinda at a stand-still. But that is because the defendant claimed he never knew he was infected. This man knew and was intentionally doing it because, in his words, 'I like to kill them'. He did not say I like to expose them to the possibility of getting HIV. He was determined to do so and with deadly intent from the start.

    If his wife were to die while he is still being held, could they then bring charges upon him according to Thai law?

    Please before you reply reason with this:

    I have a bottle of asprin, I want to kill all the old ladies on my block. I dump 200 crushed pills into a pie I bake for them. I give them each a slice of the pie. They all get sick. One of the ladies begins to die. Now will I be charged inThailand??

    I am using asprin not a knife or gun. Of course I should be charged. Just because I am using an unconventional weapon does not mean it is not murder. I stated intent, and I followed through with action intending to bring death about. That is really murder. Using HIV is just as wrong as using a knife a gun or even asprin, especially considering he stated intent prior to his actions.

    Am I seeing it wrong?

    the scum is fortunate that he didn't commit this crime in a less lenient society...e.g. a muslim country.

    If Thailand has an extradition treaty with Germany, Germany should extradite him and punish him themselves. Germany has a more developed legal system and it would be easier to pin him down for something serious enough to warrant life imprisonment.

    Thailand is governed by civil law, whereas USA uses the common law system, therefore, Stacker, where your logic would make sense in the UK, Singapore and such, it would not make sense in Thailand, China, Korea and such.

    Your concept of mens rea (intention) is a very common law concept. Actually the Thai authorities can get him down for more than just Visa overstay. If they can get a witness to testify him having intercourse with a minor, the Judge would (I suppose) be more willing than not to give him maximum for that. And from what I hear, the penalties for underage sex in Thailand is pretty steep. And God only knows what other prisoners would do to such prisoners.

    ROFL.... yeah... to even think this moron was allowed to spread the disease as he did... i mean...what is wrong with those girls moral and standards to consent in sex with this ugly beast of a "homo sapien"? most european girls(if not all...) would run screaming away or beat him with his stick if he ever asked them for sex like that...
    and what of the parents to these kids? did they know where the extra income came from? do they care? did they consent in having sex for cash? im outraged and im sad... i feel sad for the infected people....
    they are themselves responsible for getting HIV...but they are not to blame...there is a huge different there... they are responsible for having sex(not the raped ones if there was any...?&#33 but they are not blameable for catching HIV when they didnt know about it...

    i only hope some mirracle will happen to help those infected... and although im a pacifist in nature, i would still like for this man...this beast... to suffer a long and agonising punishment...after a few(read: he should be treated for as long as possible and be kept alive just to recieve the punishment) years of that, he should be given the "deathblow" with a handout of "butweeds/buckweeds"(isnt that the term?)...

    This creature is not a human being, he should be put in "big tiger" jail in solitary confinement for 10,000 years.

    "Death By Elephant" would be my verdict for this horrible monster if I were the judge...

    German at center of HIV scare may be deported
    A German man who achieved notoriety in this northeastern Thai town for allegedly trying to infect dozens of women with HIV_ the virus that causes AIDS _ was found guilty Friday of overstaying his visa, and may be deported.

    Hans-Otto Schiemann, a 56-year-old former sailor from Schweinfurt in Bavaria, caused a panic locally after his Thai wife accused him of deliberately trying to infect up to 100 local women by having paid sex with them.

    His wife, from whom he is estranged, has full-blown AIDS, and Schiemann claims to be HIV-positive, although he won't let himself be tested for the virus.

    Schiemann says he is being persecuted for personal reasons by a police officer, and no evidence has surfaced supporting his wife's claims.

    The Chaiyaphum provincial court found him guilty Friday of overstaying his visa, which expired several years ago, and sentenced him to 58 days in jail.

    Because he has already served that amount of time awaiting trial, Schiemann was handed over to immigration police, who are expected to deport him.

    58 days and he is a free man in Germany. Such a pathetic system, this is why riots, lynchings, revenge killings, and government critiscism take place, lack of authority. Failure to bring justice, brings only more problems because justice will be delivered by citizens rather than the government.
